Why It's Critical
Your Terms & Conditions (T&C) is the legal contract between you and your users. Without it, you have no legal ground to ban abusive users, and you could be held liable for errors on your site.
5 Clauses You Must Have
1. Limitation of Liability
Crucial. It states that you are not responsible for damages (like data loss or financial loss) arising from the use of your site.
"IN NO EVENT SHALL [COMPANY] BE LIABLE FOR..."
2. Termination Clause
Gives you the right to ban users or delete accounts at your sole discretion, without notice, if they violate your rules.
3. Governing Law
Defines which country or state laws apply. If you live in New York, you want disputes settled in New York courts, not in a user's home country.
Global Compliance (GDPR & CCPA)
While T&C covers the "Rules", privacy laws require separate disclosures usually found in a Privacy Policy. However, your T&C should reference your privacy practices.
Always keep your Terms & Conditions and Privacy Policy as separate documents/pages. Combining them can lead to legal ambiguity regarding consent.
